Welcome to Payleads.in (“Payleads”, “we”, “us”, or “our”).

Payleads.in is an online real-estate listing platform that provides technology and marketplace services through which property brokers, agents, owners and authorised advertisers can publish property listings and prospective Buyers can search properties and contact the relevant advertiser directly.

These Terms & Conditions (“Terms”) govern your access to and use of Payleads.in.

By accessing, browsing, registering on or using Payleads.in, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the website.

1. Nature of Payleads.in

Payleads.in is a technology platform that facilitates the discovery of property listings and communication between property Advertisers and prospective Buyers.

Unless expressly stated otherwise:

  • Payleads does not own the properties displayed on the platform.
  • Payleads is not the seller, landlord, builder, developer or owner of listed properties.
  • Payleads does not itself negotiate property transactions between Buyers and Advertisers.
  • Payleads does not guarantee the availability, legality, ownership, title, quality, condition, pricing or suitability of any property.
  • Any transaction, agreement or arrangement between a Buyer and a Broker/Advertiser is solely between those parties.

Users should independently verify all property and advertiser information before entering into any transaction.

2. Property Listings

Brokers and Advertisers may list properties on Payleads.in subject to these Terms.

Advertisers are responsible for ensuring that all information submitted by them is:

  • Accurate
  • Complete
  • Current
  • Lawful
  • Not misleading
  • Supported by appropriate authority or documentation where required

This includes property:

  • Price
  • Location
  • Size
  • Availability
  • Specifications
  • Images
  • Amenities
  • Ownership or authority to advertise
  • Project information
  • Other material claims

Payleads may modify, reject, suspend or remove listings that appear inaccurate, misleading, unlawful, duplicate, fraudulent, outdated or inconsistent with our policies.

3. Advertiser Responsibility

Every Broker/Advertiser represents and warrants that:

  • They have the right or authority to advertise the property.
  • Information submitted to Payleads is accurate to the best of their knowledge.
  • They will not publish fraudulent or misleading listings.
  • They will not impersonate another person or organisation.
  • They will not upload content that infringes third-party rights.
  • They will update or remove listings when a property is no longer available.
  • They will comply with applicable real-estate, advertising, consumer-protection and other laws.

Payleads may request additional information or verification from an Advertiser where reasonably necessary.

4. Buyer Responsibility

Buyers and other Users are responsible for independently verifying information before making any decision.

Before paying money or entering into an agreement, Buyers should independently verify, as applicable:

  • Ownership/title
  • Seller/owner identity
  • Broker authority
  • Property approvals
  • Project approvals
  • RERA registration, where applicable
  • Encumbrances
  • Taxes and dues
  • Possession status
  • Construction status
  • Property measurements
  • Pricing
  • Documentation
  • Terms of sale, lease or other transaction

Payleads does not replace professional legal, financial, property or technical due diligence.

5. Direct Contact Between Buyer and Broker

When a Buyer selects a property and chooses to contact the Broker, Payleads may facilitate the exchange of contact information or communication.

After contact is established, the Buyer and Broker may communicate directly.

Payleads is not responsible for statements, promises, negotiations, payments, documents or representations made by either party during or after such communication.

6. No Guarantee of Property Transactions

Payleads does not guarantee that:

  • A listed property is available.
  • A property description is accurate.
  • A property will be sold or rented.
  • A Broker will respond to an enquiry.
  • A Buyer will complete a transaction.
  • A listed price will remain unchanged.
  • Any property is suitable for a particular Buyer.
  • Any transaction will be successful.

All property decisions are made at the User’s own discretion and risk.

7. Prohibited Listings and Activities

Users must not use Payleads.in to:

  • Publish fake or fraudulent properties
  • Publish misleading advertisements
  • Advertise properties without appropriate authority
  • Upload stolen or unauthorised photographs
  • Impersonate another Broker, owner or organisation
  • Publish duplicate listings intended to manipulate search results
  • Manipulate reviews or ratings
  • Use automated systems to abuse the platform
  • Collect or misuse other Users’ personal information
  • Send spam or unsolicited communications
  • Upload unlawful, defamatory, obscene or infringing content
  • Promote illegal property transactions
  • Engage in fraudulent or deceptive activities

Payleads may immediately suspend or terminate accounts involved in prohibited activities.

8. Listing Content and Intellectual Property

Advertisers retain ownership of content they submit, subject to the rights necessary for Payleads to operate the platform.

By uploading photographs, descriptions, logos, videos or other content, the Advertiser grants Payleads a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, format, modify for technical purposes and promote that content in connection with Payleads and its services.

Advertisers confirm that they have the necessary rights to provide such content.

Payleads owns or licenses the website’s software, design, branding, logos, text, graphics and other platform materials.

No part of Payleads.in may be copied, reproduced, modified, distributed or commercially exploited without permission, except as permitted by law.

9. Account Security

Where registration is required, Users are responsible for:

  • Maintaining the confidentiality of login information
  • Providing accurate information
  • Preventing unauthorised use of their account
  • Informing Payleads if they suspect unauthorised access

Payleads is not responsible for losses resulting from a User’s failure to protect account credentials.

10. Listing Visibility and Search

Payleads may determine how property listings are displayed, categorised, ranked or promoted.

Listing visibility may depend on factors including:

  • Relevance
  • Location
  • Property category
  • Listing quality
  • Completeness
  • Recency
  • User search criteria
  • Platform policies
  • Promotional arrangements, where applicable

Payleads may change its search, ranking or display mechanisms from time to time.

If Payleads introduces paid listing packages, subscriptions, featured listings, promotional placements or other paid services, the applicable price, duration, features and payment terms will be displayed before purchase.

Advertisers are responsible for reviewing the applicable package before making payment.

Unless specifically stated otherwise, payment for a listing or promotional service does not guarantee any particular number of enquiries, leads, calls, visits, sales or transactions.

12. Cancellation and Refunds

Where any paid service is offered, cancellation and refund terms applicable to that service will be displayed at the time of purchase or in the relevant package terms.

Where a service has already been substantially provided, refunds may not be available except where required by applicable law or expressly stated in the relevant service terms.

13. Third-Party Services and Links

Payleads may contain links to third-party websites, payment services, maps, communication platforms or other services.

Payleads does not control and is not responsible for third-party services.

Use of third-party services may be subject to their own terms and privacy policies.

14. Suspension and Termination

Payleads may suspend, restrict or terminate an account or listing where we reasonably believe that:

  • These Terms have been violated.
  • The listing is fraudulent or misleading.
  • The account is being misused.
  • The activity may harm other Users or Payleads.
  • The activity may violate applicable law.
  • The account creates a security or operational risk.

Where appropriate, Payleads may remove or disable access to related listings.

15. Disclaimer

Payleads provides the platform on an “as available” and “as is” basis to the extent permitted by applicable law.

We do not warrant that:

  • The website will always be available or uninterrupted.
  • All listings will be accurate or current.
  • The platform will be error-free.
  • All communications will be successful.
  • Every property or Advertiser will meet a User’s expectations.

Nothing in these Terms excludes any liability or legal right that cannot lawfully be excluded under applicable law.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Payleads shall not be responsible for losses arising from:

  • Transactions between Buyers and Brokers
  • Incorrect or misleading information supplied by Advertisers
  • Property ownership or title disputes
  • Fraud committed by Users or Advertisers
  • Property defects
  • Changes in property prices or availability
  • Failure of a Broker to respond
  • Failure of a Buyer or Broker to complete a transaction
  • Third-party services
  • Communications between Users outside the Payleads platform

Nothing in these Terms is intended to exclude liability that cannot legally be excluded.

17. Indemnification

To the extent permitted by applicable law, an Advertiser or User agrees to indemnify and hold Payleads and its directors, employees, affiliates and service providers harmless from claims, losses, damages, liabilities, costs or expenses arising from:

  • Their violation of these Terms
  • Their unlawful activity
  • Their listing or content
  • Their infringement of third-party rights
  • Their representations to another User
  • Their property transaction or dispute with another User

18. Complaints and Grievance Redressal

Users may report:

  • Fake listings
  • Misleading information
  • Fraudulent activity
  • Copyright or intellectual-property concerns
  • Privacy concerns
  • Other violations of these Terms

Payleads will review complaints and take appropriate action based on the circumstances and applicable law.

19. Changes to These Terms

Payleads may update these Terms from time to time.

Updated Terms will be published on the website with a revised Effective Date.

Continued use of Payleads after the updated Terms are published constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

20. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Subject to applicable law, courts having jurisdiction over Gautam Buddh Nagar, Uttar Pradesh (Noida) shall have jurisdiction over disputes arising in connection with these Terms.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to remain in effect.

22. Entire Agreement

These Terms, together with the Privacy Policy and any additional policies or service-specific terms published by Payleads, constitute the terms governing your use of Payleads.in.
